Each of our website Sorafinance.com, our mobile application and any related URLs (each and collectively, as appropriate, the “Site”) is brought to you by SoraFinance, Inc. (“Sora,” “we,” “us,” or “our”). This Privacy Policy provides information about our policies and procedures regarding the collection, use, and disclosure of Personal Information received through the Site from visitors and registered users of the Site (the “Privacy Policy”). This Privacy Policy is incorporated into, and is part of, our Terms of Use which govern your access to the Site and/or your use of the Site and of the Content (as defined in the Terms of Use) and the services made available on or through the Site (collectively, the “Services”). What information is collected on the site

In order to onboard you as a registered user of our Services (“Registered User”), We may collect personal information (collectively referred to herein as "Personal Information") from you such as contact information (e.g., name, mailing address, phone number and email), financial information (e.g., bank accounts, brokerage account numbers, investment types), last four digits of your social security number, unique identifiers (e.g., user name, account number or password), demographic information (e.g., age, education, and personal interests). 

A. Financial Data. Registered Users who use our Services to obtain a loan will be asked to provide certain financial data, such as information concerning your existing indebtedness including (in certain circumstances) the actual underlying loan documents and account statements.  We will also request that you provide information concerning the loan you wish to obtain.  We may also use communications with, and information collected by, independent financial service providers that may refer you to us.  In addition, we may ask for the last four (4) digits of your social security number in order to do a “soft credit pull” with relevant third party credit reporting agencies.  

B. Information We Collect About Your Interaction with the Site. We collect additional information about your interaction with the Site without identifying you as an individual (“Anonymous Information”), by using cookies on our Site. For example, we receive certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses. We may use Anonymous Information for any purpose in our discretion. For clarity, Anonymous Information means information that is not associated with or linked to your personal information and does not permit the identification of individual persons.

How information collected on the site is used and shared

A. How We May Use Your Information. We may use your Personal Information for any of the following purposes: (i) to operate the Site and provide the Services; (ii) to respond to your requests and inquiries; (iii) to contact you and to communicate with you about your use of the Services and your Registered User account; (iv) to notify you about important changes to our Services, such as updates or revisions to this Privacy Policy or our Terms of Use, security announcements or other similar messages; (v) to review Site usage and operations and to improve the content and functionality of the Site and our Services; (vi) to provide you with information and materials about our products and services; (vii) to address problems with the Services; and (viii) to protect the security or integrity of our Services, our Registered Users and our business.

How We Share Information

  1. Sharing Information With Lending Partners. We will share your Personal Information as you direct to our third party lending partners (the “Lending Partners”) whom you select as part of our borrower/lender matching process. Such Lending Partners may use and retain information we share with them at your direction whether or not you ultimately obtain financial products or services from such Lending Partners. These Lending Partners’ processing of Personal Information is governed by their own privacy policies and privacy notices.

B. Sharing of Information Generally. We will not sell or lease your Personal Information to any third party. Except as otherwise expressly provided in this Privacy Policy, Sora will only share your Personal Information: 

  1. When we believe in good faith that disclosure is necessary to protect or enforce our legal rights to property, protect your safety or the safety of others, investigate fraud, or respond to a government request;

  2. To our subsidiaries or affiliates;

  3. To provide you with information relating to products or services that we believe you may find of interest, including working capital or financing solutions from third parties if we cannot fulfill your needs. In these cases, we will only share basic information, such as your contact information, company name, and the amount of funds you requested;

  4. As required by law, such as in response to a subpoena, summons or similar legal process in general;

  5. To third parties who support us in providing products and services to you such as customer service, credit checks, bank account verification, secure data storage, transfer or payment or similar services. These third parties will be authorized to use your personal information only as necessary to provide services to us;

  6. To our investors, partners, lenders and/or auditors during their review or audit of our business;

  7. To a buyer or successor entity in the event of a merger, acquisition or sale; or

  8. To an asset purchaser for an asset sale.

Third parties who have access to your Personal Information are required to adhere to privacy standards at least as stringent as those set forth in this Privacy Policy.

Accessing, changing or removing personal information

If you are a Registered User, we urge you to review your Personal Information regularly to ensure that it is correct and complete. We provide an easy way via your online account profile for you to access, correct, update or remove Personal Information that has previously been provided to us. You can review your Personal Information and make any necessary changes at any time, by logging in to your Registered User account. If you are unable to edit your Personal Information by logging into your Registered User account, please contact us for assistance at contact@Sorafinance.com.

Opting out

We may also use your contact information to send you marketing and promotional messages. If you do not want to receive such messages, you may opt out by following the instructions in the message. Please understand that if you choose not to receive promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us. Security of your Personal Information

We have implemented reasonable technical and organizational measures designed to deter unauthorized access to and use, destruction of, modification of, or disclosure of personally identifiable information we collect via the Site.  Regardless of the precautions taken by us or by you, no data transmitted over the Internet or any other public network can be guaranteed to be 100% secure.  We cannot ensure or warrant the security of any information you transmit to us and you provide all personally identifiable information via the Site at your own risk.  You are responsible for maintaining the security of your Registered User profile information, including your password and for any and all activities that occur under your account. 

Notice to users in the event of a security breach

If a Registered User’s Personal Information is compromised as the result of a breach of security, we will use commercially reasonable efforts to attempt to notify affected Users directly, or via the Site, of the breach if we determine that the information is sensitive, in accordance with this Privacy Policy and the Terms of Use, or as otherwise required by applicable law.

Cookies and log data

A. Tracking Technologies. Unique identifiers such as cookies (which are small text files stored locally on your computer that help store user preferences and may be html files, Flash files, or other technology), web beacons or clear gifs (which are small pieces of code placed on websites used to collect advertising metrics, such as counting page views, promotion views, or advertising responses, tags and scripts or similar technologies (collectively referred to as “Tracking Technologies”) are used by Sora and our marketing, analytics, or other service providers to understand Site usage, help customize our content, offerings or advertisements on the Site, personalize your experience on the Site (e.g., to recognize you by name when you return to the Site, save your password in password-protected areas, or save your online settings), analyze trends, allow users to move between associated websites without logging into each site, and other purposes related to our management and administration of the Site. In many Internet browsers, you can choose to delete, disable, turn off or reject most Tracking Technologies through the “Internet Options” sub-option of the “Tools” menu option of your browser or otherwise as directed by your browser’s support feature. Additional information on deleting, disabling, rejecting or turning off Tracking Technologies may be available through your browser’s support feature. Please consult the “Help” section of your browser for more information. Please know that certain areas and features of our Site can only be accessed in conjunction with cookies or similar devices and you should be aware that disabling cookies or similar devices might prevent you from accessing some of our content. We do not currently respond to “do not track” signals or other mechanisms that might enable users to opt out of tracking on our Site.

B. Log Files. Log data collected on web servers supplies us with aggregate information about the number of visits to different pages on our Site. We use such aggregate information to improve access to our content based on our visitors’ browsers and operating system types to make our content available to as many users as possible. We do not link the “log data” collected to personally identifiable information submitted by users when participating in our activities. This Privacy Policy covers the use of cookies by Sora and does not cover the use of cookies by any advertisers. Some of our third-party providers (e.g., third-party advertisers) may use cookies on our site. We have no access to or control over these cookies.

Links to other sites

Our Site may contain links to other websites. The fact that we may link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you. Other sites follow different rules regarding the use or disclosure of the Personal Information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit. Please be aware that the terms of our Privacy Policy does not apply to these third party websites.

Children’s privacy

This Site is not intended for, or designed to attract, children under the age of 13 and as such, we do not intentionally gather information from individuals who are under the age of 13. Upon notification that a child under 13 has provided us with personally identifiable information, we will delete the child’s personally identifiable information from our records.

Privacy rights of California residents

Under California law, we must provide California residents with a summary of their privacy rights. California law requires us to inform you, at your request, (a) the categories of personal information we collect and the third parties we share that information with; (b) the names and addresses of such third parties; and (c) examples of the products marketed by such companies. Additionally, the Act requires us to allow you to control who you do not want us to share that information with. When contacting us, please indicate your name, address, email address, and what personal information you do not want us to share. Your request should be labeled “California Customer Choice Notice,” and 30 days should be allowed for a response. There is no charge for controlling how your personal information is shared. If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. 

Under the California Consumer Protection Act of 2018 as amended (“CCPA”), a California consumer has the following special rights:

  • right to request that the business disclose what personal information it collects, uses, discloses, and sells;

  • right to request the deletion of their personal information collected by the business; and

  • the right, at any time, to direct a business that sells personal information about the consumer to third parties not to sell the consumer’s personal information (“right to opt-out”).

Over the past twelve (12) months, we have not disclosed any personal information to any third parties, but in the future, we expect to disclose the following categories of personal information to service providers or other parties for business purposes:  contact information, including full name and email address; information you submitted for purposes of accessing or using the Services.

Based on our understanding of the term "sell" under the CCPA, we do not sell your personal information.

You may directly revise, correct, or delete the personal information you provide via your user account.  Alternatively, to exercise their rights and request copies of the data collected about them in the past 12 months, that their personal information collected by Sora be deleted, or to exercise their right to opt out, California residents may make a request at contact@Sorafinance.com.  Such request must include sufficient information to allow us to verify that you are the person about whom we have collected personal information and describe your request in sufficient detail to allow us to understand, evaluate, and respond to it. Opt-out requests may be canceled by making an opt-in request via your user account or by contacting us at contact@Sorafinance.com. 

For any of the above-mentioned rights, you may designate an authorized agent to make a request on your behalf. In the request, you or your authorized agent must provide information sufficient for us to confirm the identity of an authorized agent. We are required to verify that your agent has been properly authorized to request information on your behalf and this may take additional time to fulfill your request.

We will work to respond to your valid request within 45 days of receipt. We will not charge you a fee for making a valid request unless your valid request(s) is excessive, repetitive, or manifestly unfounded. If we determine that your valid request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

We will use the information you provide to make your CCPA rights requests to verify your identity, identify the personal information we may hold about you, and act upon your request. We strongly recommend that you submit the email that you used when you registered with the Services. After you submit a CCPA rights request using one of our forms, you will be required to verify access to the email address you submitted. You will receive an email with a follow-up link to complete your email verification process. You are required to verify your email in order for us to proceed with your CCPA rights requests. Please check your spam or junk folder in case you can't see the verification email in your inbox. International visitors

Sora and its servers are located in the United States and our services are directed towards the United States market, and our Privacy Policy has been prepared to comply with applicable United States law.  We do not currently direct our lending resources towards international borrowers.  If you are an international visitor, you should note that by providing your Personal Information on or through the Site, you are: (i) consenting to the transfer of your Personal Information from regions outside the United States to the United States which may not have the same data collection and protection laws as the country in which you reside; and (ii) consenting to the use of your Personal Information in accordance with this Privacy Policy.

Changes to this privacy policy

We reserve the right at any time to make changes to this Privacy Policy simply by posting such changes or updates on the Site and without any other notice to you. If we do this, we will indicate at the top of the page the date the Privacy Policy was last updated. Any such changes or updates will be effective immediately upon posting on the Site. Each time you use the Site, the current version of this Privacy Policy will apply. You understand and agree that your continued use of the Site after we have made any such changes constitutes your acceptance of the most current Privacy Policy, as amended. You can always refuse to accept the changes to our Privacy Policy by terminating your use of the Services.
